Settlement Terminates Catalyst Sales of Counterfeit Anti-Theft Tags in the United Kingdom
NEUHAUSEN, Switzerland — May 29, 2013 — Tyco Retail Solutions (www.tycoretailsolutions.com), a leading global provider of retail performance and security solutions, announces today that Sensormatic Electronics LLC (a company within the same Group) has settled a lawsuit it filed in the United Kingdom (UK) against Algreta Solutions Ltd t/a Catalyst, an independent supplier of security tags to retailers.
The suit concerned infringement of European Patent (UK) No. 0 725 199 (“Security tag having arcuate channel and detacher apparatus for the same”), infringement of Community Trade Mark No. 1919919 ( ) and passing off in connection with Catalyst’s sale of Acousto-Magnetic (AM) Electronic Article Surveillance (EAS) hard tags in the UK by reference to , the name and trade marks SUPERTAG and SENSORMATIC.
Catalyst has agreed not to sell AM EAS hard tags in the UK which infringe Tyco’s patent or its , SENSORMATIC and SUPERTAG trade marks. In addition, Catalyst has paid Sensormatic financial consideration by way of compensation and legal costs. The settlement with Catalyst is another example of the strength of Tyco’s intellectual property covering its genuine Sensormatic brand AM EAS technology.
“We are very pleased with the settlement,” said Scott Clements, President, Tyco Retail Solutions. “Protecting our intellectual property is central to our ability to continue investing in innovative solutions that help retailers deter theft and improve profitability. This settlement gives our retail customers confidence that they are receiving genuine Sensormatic anti-theft solutions known for integrity and high performance, versus less reliable EAS technology.”
